Accepted: What are some important skills that law school students should have before they become 1Ls? Law School Toolbox: New students likely already have many of the skills that they need to be successful in law school—after all they did get admitted to law school! But we think there are a few skills worth highlighting: You need to brush up on your writing skills. Especially if you haven’t been in school for a while, or if you have been working at a job where writing isn’t a large part of your work, it might be time to brush up on your writing skills. Remember, in law school you are evaluated primarily through your writing on essay exams. Also brush up on your task and time management skills. Law school is challenging and there is a lot going on academically and socially. You need to stay organized and manage your time effectively to get everything done. If you aren’t an organized person or don’t have a task management system in place, I recommend you look at different options and try out one before you start school. This can mean one less â€Å"new† thing to do when school starts. Accepted: How does the Law School Toolbox help future law school students prepare for law school? What about once they begin law school? Law School Toolbox: We started the Law School Toolbox in order to provide law students with a tool to demystify the law school experience. We do this a few different ways. For New Law Students: This summer we are offering a free online course where we help new law students start law school right. The course covers all of the critical topics for first-year law students—such as how a law school class works, how to read and brief a case, how to take class notes, and even how to create an outline. Our goal is to offer our students a set of tools to start their first semester of law school feeling ready and confident. For All Law Students: We are passionate about empowering law students to get the most out of their law school experience. We do this in a few different ways. First, we have our blog where we write extensively on issues relating to class and exam preparation. Right now we have a great series going from our summer intern in which she is talking about lessons she learned as a 1L. Second, later this summer we will be offering online course content to help students (both in their first year and beyond) become experts at all parts of law school, from taking class notes to getting ready for exams. If students are interested in hearing more about this, we encourage them to sign up for our mailing list and be the first to hear about our new course offerings. Finally, we are offering one-on-one tutoring for law students. We have been tutoring and teaching law students for years and many students find working with a tutor invaluable as they navigate through the challenges of law school. Accepted: What else can future law students do the year or the summer before entering law school to help them prepare for whats to come (in addition to taking your course)? Law School Toolbox: There is no magic formula for getting ready for law school; however, there are definitely things you can do to get ready: Talk to lawyers you may know to start networking. Networking is becoming more and more important in this job market, and you can’t start too soon. Let people know you are going to law school. Then you can circle back with them when you are looking for work after your first year. Get yourself familiar with the law school experience. Whether it is taking our course, reading our blog, or checking out the other books, blogs, and courses out there, educating yourself on the experience can smooth the transition between pre-law school life and the start of law school. Take a break or take a trip! Most people talk about a â€Å"bar trip† after you finish the bar exam, but few people talk about a pre-law school trip! Lee took one to Costa Rica and it was a great final hurrah before starting her studies. Accepted: Can you share one or two bar exam study tips? Do you think your advice can be useful to law students, or lawyers even, after theyve completed law school and all their exams? Law School Toolbox: (1) Become an expert exam taker: Many students in law school struggle with their first-year exams. They think that perhaps they just don’t know the law well enough or they are just not used to law school exams. We would argue that there is a skill to taking legal exams (written or multiple-choice) and you should consider refining that skill throughout law school and leading into the bar exam. Lee (who is a one-on-one bar exam tutor for the California bar) works with too many students who have failed the bar exam and who say they wish they had had their newly learned exam skills while in law school. So why wait until the bar exam to learn how to take legal tests? Try to learn as much about law school exams as you can while you are in law school. Blogs and materials like the Law School Toolbox can help, but you should also use the resources made available to you through your school. Many schools have academic support offices, whose job is to help you work on your exam skills. In addition, spend time talking to your professors and trying to get as much feedback as you can on your exam writing. Some schools also have a TA program where upper-class students help you with exam-taking strategies (we were both TAs at our respective law schools). The bar exam in most states is considered a test that requires minimum competency of the law. But you cannot be minimally competent when it comes to taking an exam. Use law school as an opportunity to refine exam-taking skills so you don’t have to worry about them come bar exam time. (2) Become an expert at learning law: People outside of the law often wonder what makes the bar exam so difficult. And for many people it is just the large amount of law that you need to know for the exam (in California, the bar covers 13 subjects, depending on how you count them). Is this more law than you have likely ever memorized before? Yes. But one of the skills you have worked on in law school (whether or not you know it) involves becoming an expert at learning the law. Every day when you read new case law or went to class, you were studying law. Then, as you outlined and applied the law to fact patterns you were understanding the law and how it functions in the real world. When you get to the bar exam, you need to utilize these skills to memorize and apply the material covered on the test. You may not know as much detail about a given subject as you did for a law school final exam, but you still want to learn the law just as you did in law school. Did you make your own outlines or study materials in law school? Yes? Then do that for the bar exam. What about flashcards? Did they work for you in law school? Yes? Then make them for the bar exam. And what about after the bar exam when it is time to practice law? Well, ask any practicing attorney—all of them will tell you that they are constantly learning new law. They will have a case that covers an area of law they have never heard of and they are required to go learn new law on short notice (we both had this happen to us when we were in practice). Addies Revenge Essay - 1768 Words

Addies Revenge In William Faulkners novel As I lay Dying the reader learns about each character through the eyes of that person so to speak. Most of the important characters minds are revealed through the unique personalities and idiosyncrasies of the Bundren family, and those they encountered. One of the characters is Addie Bundren, the matriarch of the clan, and the person whos death this story moves upon. Although Addie is dead for most of the book, Faulkner still shows Addies feelings and attitude in a chapter in which she seemingly speaks from the dead. From this scene we learn about Addies personality. As a whole Addie is a pessimistic and unfulfilled woman, who marries the ignorant Anse Bundren on a whim. Addie†¦show more content†¦This totally varying portrayal still garnishes the same sub- conscious feelings of sympathy from others that dont know Anse. This ability of Anse helps combat an aspect of Addies plan. This aspect of the plan was that Addie would make Anse suffer through the indignity of carrying around her dead stinking carcass. A good example is when the family is well on their way to Jefferson and stop in the city of Mottson. While stopping in the middle of the street they were told to leave because of the smelling rotting carcass by the Marshal of the town. In this scene it seems as if Addies plan is working to perfection as everyone looks at Anse as country fool from Yoknapatawpha county until; Anse starts to weave his sad tear-jerking tale of the familys tragic trip to carry out his dead wifes last wish. While the story is being told, one gets the feeling the Marshal, and the storyteller, Albert, have totally soaked up Anses story and were totally immersed its content. That is until Jewel comes and in and, true to his role as the protector of Addies revenge, tells Anse to shut up. Even though Anse is stopped in mid-flow by Jewel, the Marshal definitely loses his edge in expelling the Bundren clan. This certainly shows how Anse overcome s the indignity of the burden of Addie, by lulling the marshal to sleep with his tale. Another aspect of Addies revenge was the fact that this trip was so time-consuming. This would definitely make Anse do some work. For instance, the employers should familiarize themselves with all potential hazards at the site and eliminate them immediately to ensure there are no incidences of falls; and in case they occur, it will leave no one injured. Employers should also emphasize the importance of safe practices such as proper equipment usage and provide refresher trainings on the safety management techniques. Employees on the other hand should follow work safe practices; use the machines and equipments appropriately. They should actively participate in the safety management training and adopt what learnt into their daily operations. The employees should also be in a position to know what safe and unsafe practice is and identify the activities that increase fall risks in order to control exposure to fall hazards. Other professionals associating with the individuals at the work place should also educate on safety management trainings. These include architects, engineers, inspectors, assessors and others. Architects and engineers should train the other workers on the hazards that expose them to falls during every phase of the project. Additionally, as they design the constructions, they should consider fall protection amongst other safety requirements required during the entire project (Excavation 1). The owners and the managers should ensure that the inspectors of the project are acquainted adequately on measures and falls protection skills. They should insist on installation of anchorage. The manufacturers of the equipment should ensure that the equipments meets all the measures and standards set by the OSHA and ANSI safety requirements to protect the workers adequately. The machines should be accompanied by manuals with detailed operational procedures and troubleshooting techniques. Any potential danger of the equipment should be explained elaborately especially those which involves improp er use of the equipment. The last parties to be discussed are the lawyers. It is their role and responsibility to ensure that the clients’ construction binds and comply with all OSHA requirements. OSHA Principles and concepts on falling issues The US department of labor has established an occupational safety health administration (OSHA) has set up standards with the aim of reducing the number of deaths and injuries arising from the construction sites. According to OSHA, falls is the leading fatalities in the construction industry. There are approximated 200 deaths reported cases annually with more than 100, 000 an injury arising from falls at the construction sites. The measures against falling is observed to ensure that workers as well as tools do not fall as this will be risky those who pass by and fellow workers. The standards emphasizes on the establishment of protection systems in every situation. Safety systems have to be put in place by experts to ensure that safety levels are boosted. The employees should be supervised properly and be trained on the proper selection, use and maintenance of the equipments. OSHA carried out a revision on its measures: According to OSHA, the work area should be clearly marked and designated (controlled access zones). This is to ensure that the workers and intruders are kept out and that only the authorized persons are allowed to access. These zones should be strongly so that they a reliable support. The working zones should be of some good stability: the surface must be rigid and tough to support heavy loads and thus avoid unnecessary collapsing. The strength of the zones should be tough. For employees dealing with excavations, the employee at the edge that is more than 6 feet deep must be protected from falling using a guardrail systems, barricades or covers. For employees moving vertically or horizontally using a rebar requires no fall protection as OSHA considers that the rebar provides similar protection. Additionally, no protection is required by an employee moving to heights below 24 feet. However, fall protection must be offered to those climbing or moving to heights more than 24 feet. Employees in a hoist area must be protected from falling 6feet or more according to OSHA fall protection standards. If the protection is to be removed for any reason, the worker must remain leaning on the access opening in order to be protected. In addition, the employee must be protected by a personal arrest system. When dealing with holes deeper than 6 feet, the employee must be prote cted by erected personal systems around the holes such as guardrail. When working near edges of a construction higher and or lower than 6 feet, the employee must be protected using fall protection system. This also applies when working on overhand bricklaying and related work and precast concrete erection and other residential constructions that have heights higher or lower than that 6 feet (OSHA 1). The fall protection systems and criteria approved by OSHA include the guardrail systems. If the employer chooses the guardrail to protect the workers than the top rails and midrails must be at least one quarter inch nominal diameter to prevent incidences of cuts and lacerations. Where are â€Å"wire and ropes are used for top rails, it should be flagged at about 6 feet intervals with high visibility material† (Geigle 23). Some the materials that must not be used as top rails and midrails include manila plastic or synthetic rope. The top sedge height toprails guardrails must be 42 inches with an allowance of 8 centimeters. Additionally, the guardrail should withstand a force of at least 200 pounds. It has been noted that â€Å"at holes the guardrail systems should be set up on all unprotected sides or edges† (Geigle 23). The next protection system advocated by OSHA is the personal fall arrest systems. The fall protection system consists of connectors, belts, an anchorage or body harness. The following criterion has been established a limit maximum arresting force on an employee to 900pounds should be used with a body belt. For employee weighing about 1800 or more a body harness should be used. The personal arrest systems must be rigged to ensure that the worker cannot fall. It is also important to bring the worker to a complete maximum deceleration distance in order to have sufficient strength that can with stand the potential of an employee falling. OSHA also emphasizes on the importance of monitoring safety systems. This ensures that the all fall ha zards are recognized. This way the workers can be trained on the dangers of the detected unsafe work practices. Regarding warning line systems, they should not be flagged at intervals more than 6 feet. The flagging should be done with highly visible material (Excavation 12). Lastly, OSHA emphasizes on the importance of training. The training teacher should be well acquainted in ways to identify hazards and how to minimize them. The trainer should offer training in the following areas recommended by OSHA a) the nature of common hazards at the sites of the construction area b) the appropriate procedure to erect, maintain, inspect and dissemble fall protection systems c) the proper use of controlled access zones and guardrail, personal fall arrest, warning line and the safety monitoring d) the role of each party in ensuring that safety is maintained when the all protection systems are in use e) the limitation on the improper use of machines and equipments f) the appropriate way to hand le the equipment and materials handling and their storage and the importance of erection of overhead protection and lastly g) the role and benefits of employees fall protection plans. OSHA demands that all the workers have to be trained on handling emergence. The document must be signed by employer, the trainer and the trainees (Geiglen 45). Conclusion In summation, the safety managers should ensure that the working environment is favorable. This includes enough working space to allow employees work safely. The roofs, floors and other surfaces should be constructed and maintained to minimize the possibility of falls and to ensure movement at the work place is not hindered. Additionally, the lighting at the place should be adequate to allow easier flow of activities at the work place. There should be no excessive glare of reflection but the lighting should be enough for safe operations. Another crucial thing is that the working environment should be well ventilated with adequate air movement to avoid too hot or too cold circulation of air in the place of work. There should also be adequate personal protective equipment to the employees. Giving the employees enough rest regimes helps in maintaining the physical fitness of their general health. Noise should be minimized if possible or alternatively the individuals should be disallowed to be at place with excessive noise exceeding eight hours. Lastly, other regulations should be maintained such as fire prevention, well fitted electricity cables to minimize electrocution, working heights and appropriate manual handling of machines and proper ventilations. The OSHA principles and concepts should be followed to the latter to significantly minimize the number of falls and other injuries in the construction industry.
